Court finds fishing licence suspension 'excessive'

Deemster says DEFA not entitled to ban brothers

A court's described the suspension of two Manx brothers' sea fishing licence as "excessive and unreasonable".

Iain David Quine and Robert Michael Quine appealed against the three-month suspension imposed by the Department of Environment, Food and Agriculture last year.

The pair were fined by the High Bailiff for breaching the terms of the licence for their boat 'Nancy Ellen', but claimed the separate ban from DEFA meant they were being punished twice for the same offence.

Deemster Corlett heard evidence from the Quines and the Department, concluding DEFA was not entitled to suspend the licence and expressed concern over how the suspension was addressed.

He added the Department hadn't kept the High Bailiff properly informed, and that Jayne Hughes would have taken the option to suspend into account when handing down her sentence.

The brothers will now be able to submit a doleance claim, and Deemster Corlett said it's inevitable that DEFA will have to pay the claimant's legal costs.
